Another lawsuit hits the Whitefish Doughnut issue

WHITEFISH- As the Doughnut issue between Whitefish and the county continues, things just keep getting more messy as another lawsuit has come up that could overturn voters repeal of the 2010 Interlocal Agreement and some residents are speaking out about their rights.

On December 22nd four Whitefish residents filed the lawsuit against the city that would challenge what Whitefish citizens already voted for in November, which was to repeal the 2010 Interlocal Agreement.

Now a group of individuals have filed a joint petition to intervene this new lawsuit. Doughnut resident Marilyn Nelson believes constitutional rights of voters will be harmed if the lawsuit is successful and their votes to repeal the 2010 Interlocal Agreement are overturned.

"I believe in the citizen's right of participation in government and their constitutionally protected rights to engage in the initiative and referendum process and I believe this lawsuit challenges that right."

On Thursday County Commissioners were supposed to have a public hearing to start the interim zoning process but that meeting is now canceled until further notice.
