Appeals court ruling backs MT wolf hunt proponents

SAN FRANCISCO - The 9th Circuit Court of Appeals has given a victory to the states of Montana and Idaho, as well as some sportsmen groups in the legal battle over hunting wolves.

The court ordered that a 2010 district court ruling concerning the partial de-listing of wolves from the Endangered Species Act be vacated, and that the underlying case be considered as moot.

Mark Holyoak of the Rocky Mountain Elk Foundation says the decision means wolves remain under state management, and that environmental groups can't use the earlier district court ruling as precedent.

Montana's third wolf hunting season, as well as an added trapping season, begins on Dec. 15 and ends Feb. 28. Montana Fish, Wildlife and Parks staff reports that there were more than 650 wolves roaming Montana at the end of 2011, and they want to reduce that number to 425.
