MISSOULA - The man who is accused of shooting an East Missoula gas station clerk wants a new lawyer and a change of venue for his trial.
Christopher Burch is facing an attempted murder and a robbery charge for the Sep. 7, 2012 incident, while the alleged getaway driver, Preston Hanna is being charged as his accomplice.
Investigators say Burch walked into the Ole's gas station in East Missoula with a rifle and demanded money from the store clerk, Adam Gallegos.
Gallegos said "no" and that's when he was shot in the back. The victim suffered several major internal injuries, including the loss of his right lung.
A judge told Burch Wednesday afternoon that he leaves it up to the defendant to show why he believes a trial needs to be moved outside of Missoula.
The Public Defenders Office will work on appointing a new lawyer, because Burch says the current one is already presuming that he's guilty.
