MISSOULA- The Missoula City Attorney says the city could legally require the owner of a home to live there if they rent out another apartment or home on their property.
The issue came up over a discussion about accessory apartments or dwelling units in a neighborhood zoned for single families.
Attorney Jim Nugent says there are local government zoning regulations across the country that require the property owner to live there as well.
The idea is still being worked out, but Nugent's research puts to rest any question about the legality of the requirement.
Dozens of citizens turned out last month at a Missoula Coty Council meeting to weigh in on the accessory dwelling units. The council voted to have the city staff to start working on the issue.
