MISSOULA - Missoula County Attorney Kirsten Pabst recently filed a petition to revoke Beau Donaldson’s parole.
His attorneys are pushing back, saying that would unlawfully punish him twice.
Donaldson is former University of Montana football player who served time for a 2013 rape, and is now accused of violating his parole.
His attorney, Peter Lacny, filed a motion to dismiss the petition in late October.
Lacny says in the brief that Donaldson was already sanctioned for his behavior by the department of corrections.
He is accused of violating his parole by spending time in bars and having a cell phone over the summer.
Donaldson’s next hearing is Nov. 28.
