Judge grants temporary injunction in Montana sheriff recall election

GREAT FALLS - A Pondera County judge has granted a temporary injunction in the recall election of Sheriff Carl Suta.

Suta had filed a temporary restraining order, a preliminary injunction, permanent injunction, and declaratory relief.

The complaint states that the recall petition is 51 words over the allotted amount of 200 words and also states the petition is not an affidavit and the allegations in the statement are insufficiently specific. 

Petitioner Stacy Welker said she was expecting the injunction to be granted and she is not worried the injunction will become permanent. 

"I have the utmost faith in our clerk and recorder Kody," she said. "I think she did her homework. After meeting with my attorney yesterday, we picked apart code word for word. They have nothing to stand on with it."

Welker added her lawyer will be filing a response to the injunction.

As of right now, the Clerk and Recorder will not be allowed to print the ballots. A hearing for the injunction has been set for Dec.11. We reached out to Sheriff Suta who had no comment about the injunction.
