Butte man shot by police charged with pointing rifle at officers

BUTTE – The man shot and wounded by Butte police early Monday morning after police claim he pointed a rifle at them was charged Thursday.

Charles Andrew May appeared in Butte Justice Court where he was charged with two felony counts of assault on a peace officer.

The 38-year-old is accused of pointing a .22 caliber rifle at officers Bryan Ellingson and Tyler Costello early Monday morning when they went to his home on Maryland Avenue on a report of a suicidal man who was trying to overdose of prescription drugs.

Police say May came to the door with a gun and ignored the officers’ orders to drop the rifle. The two officers fired several shots and struck May once in the forearm before taking him into custody.
