Woman facing animal cruelty charges in Fergus County

GREAT FALLS – A woman is facing charges of animal abuse in Fergus County.

Roxi Lea Folda has been charged with nine counts of animal cruelty in May; eight of the charges are felonies.

According to court documents, the abuse took place from January 2018 to May 2018. A goat, a donkey, and several horses died due to not having enough food or water.

Court documents state that Folda knowingly or negligently subjected the animals to mistreatment.

Folda’s trial was originally set for November but has been continued. There is no word yet on the re-scheduled trial date.

Here are the charges against Folda:

COUNT I: CRUELTY TO ANIMALS – 1ST OFFENSE, a Misdemeanor, in violation of Montana Code Annotated § 45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one reddish brown goat.

COUNT II: CRUELTY TO ANIMALS SECOND OR SUBSEQUENT OFFENSE, a Felony, in violation of Montana Code Annotated §45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one grey donkey.

COUNT III: CRUELTY TO ANIMALS SECOND OR SUBSEQUENT OFFENSE, a Felony, in violation of Montana Code Annotated § 45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one dark brown horse, causing its death.

COUNT IV: CRUELTY TO ANIMALS SECOND OR SUBSEQUENT OFFENSE, a Felony, in violation of Montana Code Annotated § 45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one dark brown horse, causing its death.

Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one grey horse.

COUNT VI: CRUELTY TO ANIMALS SECOND OR SUBSEQUENT OFFENSE, a Felony, in violation of Montana Code Annotated § 45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one light brown horse causing its death.

COUNT VII: CRUELTY TO ANIMALS SECOND OR SUBSEQUENT OFFENSE, a Felony, in violation of Montana Code Annotated § 45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one white brown horse causing death.

COUNT VIII: CRUELTY TO ANIMALS SECOND OR SUBSEQUENT OFFENSE, a Felony, in violation of Montana Code Annotated § 45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one miniature white horse.

COUNT IX: CRUELTY TO ANIMALS SECOND OR SUBSEQUENT OFFENSE, a Felony, in violation of Montana Code Annotated § 45-8-211, in that the defendant knowingly or negligently subjects an animal to mistreatment or neglect by (c) failing to provide an animal in the persons custody with food and water of sufficient quantity and quality to sustain the animals normal health. Specifically, between January 2018 and May 2018 the defendant knowingly or negligently failed to provide food and water for one white horse, causing its death.
