HELENA – New permanent rules for Montana’s medical marijuana program went into effect earlier this week, establishing procedures for testing and tracking all marijuana sold in the state.
The Montana Department of Public Health & Human Services is now proposing updates to the rules in order to address some concerns raised in recent weeks.
The biggest change would be in the allowed growing space, or canopy.
The proposed rule would establish 20 tiers of providers, based on how many patients they serve. Each tier would have a different maximum canopy, ranging from less than 400 square feet for the smallest providers to more than 80,000 for the largest.
Currently, each provider is allowed up to 50 square feet of canopy for each patient they have. But last month, some state lawmakers raised concerns that that amount was too large.
The proposed changes will have to go through a public comment period before being implemented.
